REGULATIONS about the Joint Control Commission on the resolution of the Georgian - Ossetian conflict The Joint Control Commission (JCC) was established in accordance with the Agreement of 24 June 1992 of the principles of the resolution of the Georgian – Ossetian conflict and the Protocols assigned to it for the purposes of ensuring the monitoring of the ceasefire, of the withdrawal of armed formations, of the disbandment of self –defense forces and of the operation of the security regime in the conflict zone, also maintenance the peace and prevention of the resumption of the hostilities, the implementation of the coordination of the joint activity of the Sides on the stabilization of the situation, political resolution of the conflict and economic rehabilitation of the ruined regions, the return and housing of the refugees and IDPs. The Joint Control Commission will be the acting permanent body of the four Sides that will take part in the conflict resolution process and removal of its consequences. The highest organizational instance of the Joint Control Commission will be the meeting of Plenipotentiaries of the Sides in the person of the Heads of the representations of the Sides and other members of the Joint Control Commission. The implementation of the decisions and recommendations of the Joint Control Commission will be implemented by the functional working groups set under the Joint Control Commission. The Joint Control Commission will include the special representatives of the ministries and departments (at discretion of the sides) appointed by the state bodies of the Sides and entrusted to implement the coordinated decisions on all issues regarding the full-scale resolution of the Georgian - Ossetian conflict. The functional working groups on the main directions of the activity of the Joint Control Commission will be headed by one of the members of the Joint Control Commission as agreed by the Sides. The OSCE Mission to Georgia will take part in the work of the Joint Control Commission. The Joint Control Commission will be entrusted with the following functions and tasks: monitoring of the implementation of the agreements of the Sides on the resolution of the Georgian - Ossetian conflict, the elaboration of the regulations and realization of purposeful measures on their implementation; elaboration and conducting of the activities to create the conditions for the resolution of political, military, economical, humanitarian, informational and other problems and also to coordinate the activity of the law enforcement bodies of the Sides; promotion of further development of the dialogue and assistance in the political resolution of the conflict; elaboration and implementation of the complex measures concerning the return, reception and housing of the refugees (the IDPs) with the participation of the UNHCR; consideration and practical resolution of the issue of the economical rehabilitation of the regions in the Georgian - Ossetian conflict zone; monitoring the observance of the human rights and national minorities in the conflict zone. The JCC will create the working groups including appropriate specialists – the representatives of the Sides to implement the above mentioned functions and to solve the tasks on the main directions of the work. These working groups will coordinate: political issues; issues of the observance of peace, security and the strengthening of the law and the order; issues of the economical rehabilitation of the regions in the Georgian - Ossetian conflict zone; issues of the humanitarian help to the population and refugees (the IDPs) return to the places of permanent residence; other issues as needed. The working groups will conduct the work to prepare analytical materials, the draft decisions of the Joint Control Commission and to conduct negotiations on the issues within their competence. In case of need they will have the right to involve into the work appropriate experts, to demand and receive necessary data from the appropriate state departments and institutions. The conclusions and the proposals of the working groups will be considered at the meetings of the Joint Control Commission to take final decisions. The terms of reference of the Joint Control Commission will cover the coordination of the activity of the Peacekeeping Forces and the observers appointed by the Sides. The Joint Control Commission will interact with the Peacekeeping Forces operating in the conflict zone and take decisions on the further use of the aforementioned forces. On basis of the Mandate of the Agreement about the principles of the resolution of the Georgian - Ossetian conflict and the Protocols assigned to it the Command of the Peacekeeping Forces will elaborate and implement necessary measures to maintain the peace and the law and the order, to prevent the resumption of the hostilities, to disarm illegal armed formations, to offer in due way the proposals in relation to the effective use and perfection of the organizing of the Peacekeeping Forces in the conflict zone. The Joint Control Commission will coordinate its activity with the Joint body to solve the issues of financing, supplies of materials and machinery and organization of the building of the objects in accordance with the Agreement between the Government of the Russian Federation and the Government of the Republic of Georgia about the economical rehabilitation of the regions in the Georgian - Ossetian conflict zone of 14 September 1993 and the Protocol of the Agreement. The Joint Control Commission will consider and assess the situation in the Georgian - Ossetian conflict zone on basis of the data presented by the competent bodies of the Sides. For the purpose of providing unbiased information to the public the Joint Control Commission will present to Mass Media the materials about the resolution process via the multilateral Press Center set under the Joint Control Commission. The members of the Joint Control Commission will enjoy diplomatic immunity and privileges in compliance with the standards of international law. The members of the Joint Control Commission will have the right to move freely throughout the territory of the conflict zone; the representatives of the Sides on the grounds will render assistance to the members of the Joint Control Commission and will be responsible for their security. The official headquarters of the Joint Control Commission will be Tskhinval. In case of need the plenary sessions of the Joint Control Commission as agreed by the Sides can be held in other places. The meetings of the Joint Control Commission will be held in case of need, but no less than once in two months. The meeting will be presided over by one of the heads of the representations of the Sides in the Joint Control Commission on the mutual agreement. The decisions of the JCC will be taken on the basis of the consensus of the sides. The Secretariat with the headquarters in Tskhinval will be established under the JCC to conduct the organizational work and to maintain contacts between the sides. The structure of the financing and the personnel number of the Secretariat will be approved by the Joint Control Commission. The funding of the Joint Control Commission and the working bodies and services assigned to it will be carried out by the Russian Federation and the Republic of Georgia on a basis of parity. The working language of the Joint Control Commission and the language of its documents will be Russian. The Joint Control Commission will terminate its activity after the achievement of the full-scale resolution of the Georgian - Ossetian conflict.
